Tangerine Bike Share Toronto Official Contest Rules

The Tangerine Bike Share Toronto Contest (the “Contest”) is brought to you by Tangerine Bank ("Tangerine" or the "Sponsor") with its head office located at 3389 Steeles Avenue East, Toronto, Ontario M2H 0A1. By entering this Contest, you agree to abide by these Official Contest Rules (the “Rules”) and the decisions of Tangerine, which are final and binding. No deposit or Account opening necessary. Contest is void in whole or part where prohibited by law. Entrants acknowledge and agree that Bike Share Toronto is in no way responsible for the administration of the Contest or the selection of Winners. Any questions, comments or complaints regarding the Contest must be directed to Tangerine and not Bike Share Toronto.

1. Contest Period

The Contest runs from August 18, 2023 at 12:00:01 am (ET) to October 17, 2023 at 11:59:59 pm (ET) (the “Contest Period”).

2. Who Can Enter

The Contest is open to Tangerine Clients who have received a communication about the Contest directly from Tangerine and who are legal residents of Canada 18 years of age or older at the time of entry, except employees of Tangerine or any of its affiliates (including The Bank of Nova Scotia), employees of Bike Share Toronto, and their advertising and promotional agencies; shareholders, board of directors, or agents of the Sponsor and Bike Share Toronto, including their affiliates and agents; and the immediate family members and/or those living in the same household of any of the above. Potential winners may be required to provide the Sponsor with proof that the potential winner is the authorized Account holder. “Immediate family” is defined as parents, siblings, children or spouse.

3. How to Enter

No purchase necessary to enter. A deposit or Account opening won’t increase your chances of winning. Void where prohibited.

Entrants can enter the Contest in one of the following ways (each an “Entry Method”). There is a limit of five (5) entries per person regardless of the Entry Method.

Tangerine Credit Card or Tangerine Client Card Payment Method: During the Contest Period, you’ll automatically receive one (1) entry into the Contest when you pay for your Bike Share Toronto ride, daily pass or annual membership using your Tangerine Credit Card or using your Tangerine Client Card to complete a debit transaction on your Tangerine Chequing Account. Each of the following payment methods will automatically generate one (1) entry per completed transaction:

  1. 1. Pay for a Bike Share ride, monthly pass or annual membership with your Tangerine Credit Card or Client Card registered on the PBSC app (The official app for Bike Share Toronto) or at bikesharetoronto.com.
  2. 2. Pay for a Bike Share ride, daily pass or annual membership with your Tangerine Credit Card, or Tangerine Client Card at any Bike Share Kiosk in Toronto and the GTA.

(i) Alternate Means of Entry: To enter the Contest without paying for a Bike Share ride, daily pass or annual membership with your Tangerine Credit Card or Tangerine Client Card, you can email your full name and phone number to socialmedia@tangerine.ca.

There is a limit of five (5) entries per person and one (1) prize per entrant regardless of the Entry Method. If it's discovered that an entrant has attempted to use or attempt to use multiple names, Tangerine Accounts, email addresses or identities to enter, or otherwise participate in the Contest, then (in the sole and absolute discretion of the Sponsor) the entrant may be disqualified from participation in the Contest. Use or attempted use of multiple identities, email addresses and/or any automated system to enter or otherwise participate in this Contest is prohibited and is grounds for disqualification.

4. Prizes

During the Contest Period, a total of 50 prizes consisting of the following will be available to be won (each a “Prize”):

Twenty five (25) Annual 45 Bike Share Toronto memberships, each valued at $120

Twenty five (25) daily passes, each valued at $15

Except at the discretion of the Sponsor, Prizes are non-transferable and must be accepted as awarded. The Sponsor reserves the right to substitute a Prize in whole or in part if all or any of the components of the Prize are unavailable with another prize of equal or greater approximate value. In the event that a winner is unable to redeem their Prize, due to reasons beyond the control of the Sponsor, its employees, representatives, agents and all parties associated with this Contest, no compensation or substitution prize will be provided. Any costs or expenses incurred by winners in claiming or using their Prizes will be the responsibility of the winners.

Additional Bike Share terms and conditions apply to all Prizes.

5. Prize Draw

At or about 12:00pm (noon) ET on October 23, 2023 (the "Draw Date"), at 3389 Steeles Avenue East, Toronto, Ontario M2H 0A1, fifty (50) potential Prize winners will be selected by random draw from among all eligible entries received during the Contest Period. Odds of an entry being drawn will depend on the number of eligible entries received during the Contest Period. The drawing may be conducted electronically by a designated representative of the Sponsor.

6. Selection of Winners

Selected entrants will be notified within forty-eight (48) hours of the Draw Date by a Sponsor representative and will be given instructions on how to claim the Prize. The Sponsor or its designated representative will make a minimum one (1) attempt to contact the selected potential Prize winner by email or phone. If a selected entrant can’t be contacted within 48 hours of the Draw Date, or if there is a return of any notification as undeliverable, the Prize will be forfeited and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate potential Prize winner from among the remaining eligible entries (in which case the foregoing provisions of this section will apply to the new selected entrant), and this process will continue until a potential Prize winner has been successfully contacted.

In order to be declared a Prize winner, in addition to complying with the other terms and conditions of these Rules, the selected entrant must respond to the notification by email or phone within forty-eight (48) hours and provide a valid mailing address, phone number and email address. Selected entrants must also correctly answer, unaided, a time-limited mathematical skill-testing question to be administered by mail, email or phone, as the Sponsor determines. Winners will be required to sign a release form confirming acceptance of the Prize as awarded and releasing the Sponsor and its affiliates from any liability relating to the Prize and return it to the Sponsor within seven (7) days from the date of receipt.

Once a winner is confirmed, the applicable Prize will be awarded to the winner through an email with Prize redemption instructions, which will be valid for 30 days after completion of the release form.

By accepting a Prize, the winner consents to the use by the Sponsor of their name, address (city and province), photo, image, likeness, biographical information, voice and/or any statements made by the winner regarding the Contest or the Sponsor for promotional, advertising, marketing, publicity and commercial purposes in any and all media, including but not limited to, any online announcements, worldwide in perpetuity, without additional compensation, notification, or permission, except where prohibited by law.

If a selected entrant fails to meet any of these Rules in the Sponsor’s sole discretion, or a selected entrant can’t be reached or a Prize notification is returned as undeliverable, the entrant will be disqualified. A new random draw will be conducted from among all remaining eligible entries in accordance with these Rules in order to select another potential Prize winner, who will be subject to the same conditions and could be disqualified in the same manner.

7. General Rules

By entering this Contest, entrants accept and agree to be bound by these Rules, including all eligibility requirements, and the decisions of the Sponsor which are final and binding without right of appeal on all matters relating to this Contest. All entries become the property of the Sponsor and will not be returned or acknowledged, and by participating in this Contest, entrants agree that the Sponsor may (but is not obligated to) share select entries on its social media accounts or other social media sites. Entries will not be acknowledged, and no correspondence will be entered into except with potential winners. The Sponsor reserves the right to disqualify all entrants who fail to comply with these Rules or who make any misrepresentation relating to the Contest, drawing and redemption of any Prize.

If a dispute arises regarding who submitted an entry under Section 3(i), the entry will be deemed to be submitted by the primary Account holder of the Eligible Account; the primary Account holder is the person whose name appears first on the Eligible Account statement (the “Primary Account Holder”). If a dispute arises regarding who submitted an entry under Section 3(ii), the entry will be deemed to be submitted by the authorized email account holder of the email entry; the Authorized account holder is defined as the natural person who is assigned to an email address by an Internet access or online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.

Entrants represent and warrant that their entries don’t and won’t infringe on any copyright or trademark or any other third party right or violate any applicable law or regulation, including any right to privacy or publicity. By entering the Contest, entrants grant the Sponsor a worldwide, royalty free, non-exclusive right and license to copy, distribute and display each submitted entry and use each entry in any manner including promotional, advertising, marketing, publicity and commercial uses without any further notice or payment to entrant (except where prohibited by law).

By participating, entrants release and hold harmless Sponsor, Bike Share Toronto and their affiliates, and each of their respective directors, officers, employees, advertising and promotional agencies affiliated with this Contest, participating establishments and any independent contest judges appointed by the Sponsor from any claims, actions, injury, loss, or damage of any kind, including, but not limited to, illness, personal injury or death, resulting, directly or indirectly, in whole or in part, from participating in this Contest or from the acceptance, possession, or use or misuse of the Prize or any portion thereof (including any travel/activity related thereto). This limitation of liability is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect, or consequential damages; loss of data, income or profit; loss of damage to property; and claims of third parties.

The Sponsor won’t be responsible for any failure of email during the Contest or for any problems or technical malfunction of a telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any email, online, or Internet entry to be received by the Sponsor. In addition, the Sponsor won’t be responsible for technical problems, traffic congestion on the Internet or at any website, or any combination of these including any injury or damage to an entrant's or any other person’s computer or property related to or resulting from playing or downloading any material in the Contest. The Sponsor reserves the right, at its sole discretion (subject only to applicable laws), to cancel, suspend, extend or modify this Contest without notice, obligation or liability if in the Sponsor’s opinion, there is any suspected or actual evidence of tampering with any portion of the Contest, or if virus, bugs, non-authorized human intervention, force majeure or other causes corrupt or impair the administration, security, fairness, or integrity and proper play of the Contest, or for any other reason in the Sponsor’s sole discretion. In such case, the Sponsor may select the winner(s) from all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest may be a violation of criminal and civil laws, and, if such an attempt is made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. Entries are subject to verification and will be declared invalid if they’re illegible, incomplete, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way, or otherwise not in compliance with these Rules.

The Sponsor won’t be responsible in any way for the use of, or bear any liability whatsoever in any way attributable to, the Prize awarded in this Contest or the events forming part of this Contest, including but not limited to typographical or other errors in the offer or administration of this Contest, these Rules, the selection and announcement of winners or the distribution of the Prize. Any questions or complaints regarding the functionality or use of any Prize must be directed to Bike Share Toronto. The Sponsor and its affiliates, and its and their officers, directors, partners, partnerships, principals, representatives, agents, licensees, successors and assigns (i) make no warranty, guaranty or representation of any kind concerning the Prize, (ii) disclaim any implied warranty or condition, and (iii) are not liable for injury, loss, or damage of any kind resulting from the acceptance, use or misuse of the Prize, travel related thereto or otherwise from participation in this Contest.

In the event of any discrepancy or inconsistency between the terms of these Rules and the terms or statements contained in any short-form Contest rules, advertising materials and/or the French version of these Official Rules, the terms and conditions of these English Rules will prevail, govern and control to the fullest extent permitted by applicable law.

This Contest is subject to all applicable federal, provincial and municipal laws. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of entrants and the Sponsor in connection with the Contest, will be governed by, and construed in accordance with, the substantive laws of the Province of Ontario without regard to Ontario conflicts of law principles. All entrants consent to the jurisdiction and venue of the Province of Ontario.

8. Privacy

The Sponsor is committed to respecting the privacy rights of entrants. Any personal information collected will be handled in strict accordance with the Tangerine Privacy Code and all applicable privacy legislation. The Sponsor won’t sell any personal information collected for this Contest to any third parties. Except as otherwise set forth here with respect to the Prize winner, any personal information collected for this Contest will be collected, used and disclosed by the Sponsor solely for the purpose of managing and administering this Contest. By entering this Contest, the entrant consents to the Sponsor's collection, use and disclosure of the entrant's personal information in order to manage and administer this Contest.

9. Winner name

To obtain the names of the Prize winners, available after November 30, 2023, any inquiries can be sent to socialmedia@tangerine.ca. Requests must be received within four (4) weeks of the end of the Contest Period.
