Tangerine Bank Third-Party Mobile Wallet – Terms of Use

These Tangerine Bank Third-Party Mobile Wallet - Terms of Use (the “Terms of Use’) are between you and Tangerine Bank (“Tangerine”) in connection with Third-Party Mobile Wallets.

These Terms of Use apply when a Card is added to a Third-Party Mobile Wallet or a Card is used through a Third-Party Mobile Wallet including to make a Transaction.

The Account Agreements and other agreements between you and Tangerine for a Card and Account continue to apply to the addition or use of the Card through a Third-Party Mobile Wallets, including Tangerine’s Mobile Terms, the Tangerine Credit Card Cardholder Agreement, the Client Card Agreement and the Tangerine Privacy Code (collectively, the “Account Documents”).

Up-to-date copies of the Account Documents can be found on our website at tangerine.ca.

Your mobile device manufacturer, your operating system, your wireless carrier, the Third-Party Mobile Wallet Provider and other third-party services or websites available through a Third-Party Mobile Wallet may have their own terms and conditions and privacy policies which you may have to agree to in order to use their services.

BY CLICKING THE BUTTON TO ACCEPT/AGREE TO THESE TERMS OF USE OR WHEN YOU ADD A CARD TO A THIRD-PARTY MOBILE WALLET OR USE THE THIRD PARTY MOBILE WALLET AFTER YOU’VE ADDED A CARD, IT MEANS YOU’VE READ AND AGREED TO THESE TERMS OF USE.

YOU MUST AGREE TO THESE TERMS OF USE TO ACCESS OR USE A CARD IN A THIRD-PARTY MOBILE WALLET. IF YOU DON’T AGREE TO THESE TERMS OF USE, YOU CAN’T ACCESS OR USE A THIRD-PARTY MOBILE WALLET.

1. Definitions

Below are definitions of some of the words used in these Terms of Use:

  • “Account” means the consumer (personal) chequing account (including the Tangerine Chequing Account) or consumer (personal) credit card account that is opened by Tangerine in your name and for which a Card has been issued for that Account.

  • “Account Agreements” mean the consumer (personal) chequing account agreement(s) or consumer (personal) credit card account agreement(s) that apply to the Account and the Card including the Tangerine Client Card Agreement for your Tangerine Client Card and the Tangerine Credit Cardholder Agreement for your Tangerine Credit Card.

  • “Account Documents” has the meaning given to it above.

  • "Authorized User" means a person to whom a credit card has been issued at the request of the Primary Cardholder of the Tangerine Credit Card Account.

  • "Card" or "Cards" means the debit and/or the credit card issued by Tangerine that can be added to or used in a Third-Party Mobile Wallet.

  • “Joint Cardholder” means, in the case of a Tangerine Chequing Account, a person for whom we have opened an Account for the Primary Cardholder and who is the joint or secondary owner of the same Tangerine Chequing Account with that Primary Cardholder.

  • "Mobile Device" means an eligible mobile device or other device that we permit you to use to access and use a Third-Party Mobile Wallet.

  • “Primary Cardholder” means a person for whom we have opened an Account, who is the primary owner of the Account and to whom we have issued a Card.

  • “Tangerine Client Card” means a Client Card issued by Tangerine for a Tangerine consumer (personal) Chequing Account.

  • “Tangerine Credit Card” means a Credit Card issued by Tangerine for a Tangerine Credit Card Account.

  • “Third-Party Mobile Wallet” means an online, digital, virtual or other electronic wallet of a Third-Party Mobile Wallet Provider through which Tangerine permits you to add a Card or use if you agree to and comply with these Terms of Use.

  • “Third-Party Mobile Wallet Provider” means a third party service provider (non-Tangerine) that owns, provides and/or supports the Third-Party Mobile Wallet, including the features, functionality and services available or provided through such Third-Party Mobile Wallet, regardless of the Mobile Device used to access or through which you use such Third-Party Mobile Wallet.

  • “Transaction" means any credit or debit transaction on an Account that is made using a Third-Party Mobile Wallet, including a payment by you or any transactions by any Authorized User. When a Card is used to access an Account for a Transaction like a payment, that Transaction is posted or otherwise credited or debited to the Account associated with that Card.

  • "You" and "your" means: (i) the Primary Cardholder and/or any Authorized User (if applicable) of a Tangerine Credit Card Account and (ii) the Primary Owner and/or Joint Owner (if applicable) of a Tangerine Chequing Account.

  • “We”, “us” and “our” means Tangerine Bank (Tangerine Bank is located at 3389 Steeles Avenue East, Toronto, ON M2H 0A1 (Toll-Free number 1-888-826-4374).


2. Tangerine Account Agreements Continue to Apply

Remember that your Account and Cards are governed by the applicable Account Agreements, even when you are using a Third-Party Mobile Wallet. These Account Agreements continue to apply to your use of the Accounts and Cards on or through any or all Third-Party Mobile Wallets.


3. Responsibility for Third-Party Mobile Wallets

Third-Party Mobile Wallets are provided by Third-Party Wallet Providers and those Third-Party Mobile Wallet Providers are responsible for access to, and the use and functionality of, the Third-Party Mobile Wallets.

Tangerine is not responsible for any Third-Party Mobile Wallet, including any failure of a Third-Party Mobile Wallet or any inability to use a Third-Party Mobile Wallets.

Tangerine is also not responsible for any loss, injury or inconvenience you suffer as a result of a merchant refusing to accept the use of a Third-Party Mobile Wallet including for a payment or other Transaction.

You’re solely responsible for any and all Transactions made through any Third-Party Mobile Wallet, including Transactions incurred by an Authorized User or someone you may have authorized to use a Card.

4. Adding a Card to a Third-Party Mobile Wallet

To add a Card to a Third-Party Mobile Wallet, you must follow the procedures set out by the Third-Party Mobile Wallet in their app, plus any further procedures we or the Third-Party Mobile Wallet may require.

You may not be able to add a Card to a Third-Party Mobile Wallet if: (1) you haven’t activated the Card; (2) we can’t authenticate the Card; (3) we suspect fraud or the Card has been reported lost or stolen; or, (4) the Account associated with the Card isn’t in good standing (including if your Account is past due or over-limit). In addition, Third-Party Mobile Wallets may not be available including if your Mobile Device’s operating system or software has been modified. We aren’t responsible if you aren’t able to add a Card to a Third-Party Mobile Wallet or otherwise use the Third-Party Mobile Wallet.

5. Fees or Other Charges

We don’t charge fees or other charges for the use of Third-Party Mobile Wallets under these Terms of Use. However, Third-Party Mobile Wallets Providers or other third parties, such as wireless companies or data service providers, may charge you fees or other charges to use your Mobile Device or any Third-Party Mobile Wallet.

When you use your Card to make a Transaction on an Account through a Third-Party Mobile Wallet, any interest fees and other charges that may apply to the Account for that Transaction will still apply as set out under your Account Documents. For example, if you make a payment and you don’t have sufficient funds in your Account for that payment, you may be charged an insufficient funds fee as set out by your Account Document or if your Transaction causes you to go over your credit limit on your Account you may be charged a fee for exceeding your credit limit. That’s because when you use a Card through a Third-Party Mobile Wallet it’s the same as using your physical Card for your Account.

6. Transaction Limits

Tangerine, merchants, or the payment networks may set Transaction amount limits, meaning that you may not be able to complete a Transaction using a Third-Party Mobile Wallet if the value of that Transaction exceeds these limits. If your Transaction is denied because it exceeds the Transaction amount limit, you won’t be able to use the Third-Party Mobile Wallet for the Transaction.

However, you may be able to still to use your physical Card with that merchant (not using the Third-Party Mobile Wallet), assuming your Account is in good standing, there’s no suspected fraud, and the value of the Transaction doesn’t exceed your available credit on the Tangerine Credit Card or funds available through the Tangerine Client Card. Tangerine is not responsible for any Transactions that you are not able to complete through a Third-Party Mobile Wallet including due to limits set on Transactions.

7. Replacement Cards

7.1 For Tangerine Credit Cards: If we issue you a replacement Tangerine Credit Card because you’ve reported it as lost or stolen or because it has expired, you’ll be able to continue accessing your Account(s) through a Third-Party Mobile Wallet – even before you receive the physical replacement Card in the mail – and we’ll update Third-Party Mobile Wallets with your new replacement Card’s information. Remember that even if we’ve updated your Third-Party Mobile Wallet with your new replacement Card information, you must still activate your physical Card when you receive it.

You authorize and consent to our doing these updates for you so that use of the Third-Party Mobile Wallet is not interrupted.

7.2 For Tangerine Client Cards: If we issue you a replacement Tangerine Client Card for any reason, you won’t be able to continue accessing your Account through a Third-Party Mobile Wallet using the old Card information. Once you receive your replacement Card and you must also delete the old Card information from the Third-Party Mobile Wallet. Then you must first activate the new Card and then:

1. conduct a chip and PIN Transaction with using your new replacement physical Card at a merchant location (i.e. A “chip and PIN” transaction means that you use your physical Card a merchant by inserting your Card in the payment terminal and enter your PIN in order to complete the transaction), or

2. by using the physical Card at an automatic banking machine.

After conducting one of the above chip and PIN transactions, you’ll then be able add your new Tangerine Client Card’s information to a Third-Party Mobile Wallet by following the procedures as described in Section 4 above.

8. Authorized Users and Joint Account Holders

8.1 For Credit Cards: Authorized Users may use their Tangerine Credit Card through Third-Party Mobile Wallets. As set out in the Account Agreement for the Card and Account, the Primary Cardholder is solely responsible the use of a Card by an Authorized User, even for Transactions made on the Card by an Authorized User through a Third-Party Mobile Wallet. The Primary Cardholder is bound by these Terms of Use as if the Primary Cardholder has added a Card or used the Third-Party Mobile Wallet themselves.

We’ll notify the Primary Cardholder when an Authorized User adds a Card to a Third-Party Mobile Wallet by delivering the disclosure based on the Primary Cardholder’s communication preferences.

Authorized Users may remove their Card from their Mobile Device at any time, but the Primary Cardholder won’t be able to instruct us to remove an Authorized User’s Card from a Third-Party Mobile Wallet. However, the Primary Cardholder can cancel the Authorized User’s Card on the Account at any time.

8.2 For Client Cards: Joint Account holders on a Tangerine Chequing Account are each jointly and severally responsible for all Transactions when any Card has been added to a Third-Party Mobile Wallet.

Only the Account holder who adds their Card to a Third-Party Mobile Wallet will receive a notification that their Card has been added. The Account holder who adds their Card to a Third-Party Mobile Wallet may remove their Card from their Mobile Device at any time.

9. Lost or Stolen Mobile Devices

If your Mobile Device (or the Mobile Device of an Authorized User on your Tangerine Credit Card Account) is lost, stolen, or otherwise used in an unauthorized way, or if your Credentials (see Section 11) or those of your Authorized User are compromised or you suspect they are compromised, you must immediately notify us so that we may unlink your Mobile Device from the Card that accesses the Third-Party Mobile Wallet. You will remain responsible for Transactions until you notify us as set out in this Section 9.

10. Replacing Your Mobile Device

You must delete your Card(s) from your old Mobile Device if you upgrade, change, or dispose of it or if you transfer it temporarily to a third part (for example, for repair purposes).

11. Protecting Your Card(s) on the Mobile Device

You must protect and keep confidential you user ID, passwords or PINs, and all other credentials including finger prints or other biometric information that are used to identify you for a Mobile Device, Account, Card or Third-Party Mobile Wallet or that is required for you to log into your Mobile Device (the “Credentials”) or to make purchases or other Transactions with your Card(s) using Third-Party Mobile Wallets, just as you do your physical Card(s). You must notify us immediately if you suspect or know that your Credentials are lost, stolen or are being used (or you suspect) by someone other than you.

If you share or disclose any Credentials with others, they may be able to access Third-Party Mobile Wallets and make Transactions with your Card(s) through the Third-Party Mobile Wallet or obtain your personal information. You will be responsible for Transactions made by anyone using your Mobile Device if you’ve given them your Credentials including if those Credentials are used to unlock your Mobile Device and complete a Transaction through a Third-Party Mobile Wallet.

Before adding a Card to a Third-Party Mobile Wallet, you must ensure that only your own Credentials are being used for that Third-Party Mobile Wallet.

We will consider Transactions authorized if Credentials are used.

You’re responsible for all Transactions made using your Card(s), except as specifically described in the Account Documents or as otherwise provided by law.

You must also notify us immediately if you believe there is an error on your Account relating to a Transaction or suspect fraud with your Card(s) or if your Card is lost or stolen. You will remain responsible for Transactions until you notify us as set out in this Section 11.

12. Collection, Use and Disclosure of Information

Personal information you provide to Third Parties Wallet Providers to set up or otherwise use or access Third-Party Mobile wallets is your responsibility.

We don’t and can’t safeguard this information, and it isn’t subject to the Tangerine Privacy Code. However, to the extent that personal information is collected, used and disclosed by Tangerine to third parties, this information is governed by the Tangerine Privacy Code and the Tangerine Credit Card Privacy Policy.

You agree that we may collect, use and disclose personal information about you, including information related to your Card(s) and use of Third-Party Mobile wallets, and exchange this information with third parties and the applicable payment card network (such as Mastercard or Interac) for the following purposes:

  • to verify your identity;

  • to facilitate any purchase or other transaction you initiate using a Card;

  • to make information about your Card transactions available to you in Third-Party Mobile Wallets; and/or,

  • to assist Third Party Wallet Providers in improving their Third-Party Mobile Wallets and in performing their obligations and exercising their rights under the agreements they have with you or us. Third parties may aggregate your information or make it anonymous for the purposes set out in their privacy policies or terms of use. Remember to read the privacy policy that applies to the Third-Party Mobile Wallet you are using carefully before you start to use it or add a Card.


13. Other Third-Party Agreements

Third-Party Wallet Providers may set their own terms and conditions for their Third-Party Mobile Wallets. Those terms and conditions apply when a Card is added to a Third-Party Mobile Wallet or the Third-Party Mobile Wallet is accessed or used.

These Third-Party Mobile Wallets may also include websites and other services that are integrated into the Third-Party Mobile Wallet and those additional terms and conditions such as those of your wireless carrier and other websites and services integrated into the Third-Party Mobile Wallets will also apply to the addition of a Card or the use and access to a Third-Party Mobile Wallet. Ensure you read all terms and conditions that apply to a Third-Party Mobile Wallet carefully including the privacy policy before you register a Card or access or use the Third-Party Mobile Wallet.

14. Security of Third-Party Mobile Wallets

The security of information provided to or stored by third parties, by you on your Mobile Device, or other third parties in connection with Third-Party Mobile Wallets, whether or not this information was provided by you, the payment services, or merchants, is outside of our control. We aren’t responsible if there is a security breach affecting any information collected, stored or sent in connection with Third-Party Mobile Wallets.

15. Disclaimer of Warranties and Limitation of Liability

Tangerine doesn’t own, operate or support the Third-Party Mobile Wallets or wireless networks through which those Third-Party Mobile Wallets may be available and has no control over their operations. We won’t be liable to you either directly or indirectly for any circumstances that interrupt, prevent or otherwise affect the functioning of Third-Party Mobile Wallets, such as the unavailability of Third-Party Mobile Wallets or your wireless service, communications, network delays, system outages, or interruption of a wireless connection.

Tangerine disclaims any responsibility for Third-Party Mobile Wallets or any wireless service used to access, use or maintain such services. We don’t warrant that Third-Party Mobile Wallets will be available for use, including completing a Transaction, that a merchant will have Third-Party Mobile Wallets availability or that the use of the service will be uninterrupted or error-free.

Use of Third-Party Mobile Wallets involves the electronic transmission of personal information through other third-party connections. Because we don’t operate or control these connections, we can’t guarantee the privacy or security of these data transmissions.

We aren’t responsible for your supported Mobile Device or the software or hardware it contains and make no representations, warranties, or guarantees regarding the same.

Except as otherwise provided by law, in no event will Tangerine, its direct or indirect subsidiaries, affiliates, agents, employees, service providers or representatives be liable for any damages, claims or losses incurred (including direct, compensatory, incidental, special, indirect, punitive, exemplary or consequential damages) arising out of these Terms of Use, or in any way related to the use or inability to use any Third-Party Mobile Wallets, however caused, regardless of the theory of liability (contract, tort or otherwise) and even if we’ve been advised of the possibility of such damages.

This Section 15 will survive any suspension, termination or cancellation of these Terms of Use or discontinuance of your ability to use a Card on a Third-Party Mobile Wallet by us.

16. Changes to these Terms of Use

We may change these Terms of Use without prior notice, unless we’re required to do so by law.

Notice of a change to these Terms of Use will be provided to you by sending a notice to the ‘Inbox’ section of tangerine.ca that’s available to you when you log in.

However, we reserve the right to send you a notice by regular mail (to your last address in our records) or we may provide you with notice in any of the other following ways:

  1. A notice to your email address in our records;

  2. A notice to you by courier to your last address in our records;

  3. A notice in any other way described in the Terms and Conditions.


BY CLICKING THE BUTTON TO ACCEPT/AGREE AND CONTINUING TO KEEP A CARD IN ANY THIRD-PARTY MOBILE WALLET OR CONTINUING TO USE ANY THIRD-PARTY MOBILE WALLET, YOU AGREE THAT YOU HAVE READ AND AGREED TO THE AMENDED TERMS OF USE.

IF YOU DON’T ACCEPT A CHANGE TO THESE TERMS OF USE, YOU MUST REMOVE ALL CARDS FROM ALL THIRD-PARTY MOBILE WALLETS, AND YOU WON’T BE ABLE TO USE YOUR CARDS ON ANY THIRD-PARTY MOBILE WALLET.

17. Term

When you or an Authorized User adds a Card to a Third-Party Mobile Wallet on your Mobile Device, that Third-Party Mobile Wallet will be immediately available for use.

18. Cancellation or Suspension of Third-Party Mobile Wallets; Termination

At any time and without notice to you for any reason we may:

  • change the type of Cards that are eligible to be added to a Third-Party Mobile Wallet,

  • stop participating in any or all Third-Party Mobile Wallets,

  • stop allowing you to access any Third-Party Mobile Wallet,

  • block you from adding a Card to a Third-Party Mobile Wallet,

  • suspend your ability to use a Card to make purchases or other Transactions using a Third-Party Mobile Wallet;

  • cancel your ability to continue to use a Card in a Third-Party Mobile Wallet; or

  • terminate your use of any Third-Party Mobile Wallet.


We may do any of the above for any reason including if you fail to comply with these Terms of Use or any Account Documents, if we suspect fraud, if your Account isn’t in good standing, if there’s a change in law, or for other reasons we determine.

You may remove a Card from a Third-Party Mobile Wallet at any time by following that Third-Party Mobile Wallet Provider’s procedures for removing it.

You may terminate the use of a Third-Party Mobile Wallet by deleting it from your Mobile Device.

If you or we terminate or otherwise cancel or suspend the use of the Third-Party Mobile Wallet, any services related to it will immediately terminate. Any payment made using the Third-Party Mobile Wallet prior to such deletion will continue to be processed, including the Transaction on your Account and the sharing of your information with the Merchant.

19. Place of Contract

These Terms of Use are entered into in the province or territory that you provided and verified as your billing address for your Card and Account unless your Account Agreement expressly states otherwise or is governed by another province or territory.

20. Communicating with You or Us

When you add a Card to any Third-Party Mobile Wallet, we’ll send you a confirmation notice electronically, although we reserve the right to send you that confirmation or other information by regular mail. Also see Section 16 (“Changes to these Terms of Use”) for other methods that we communicate with you.

21. Language
