Terms and Conditions
Tangerine uses Plaid Technologies Inc. ("Plaid") to gather data from accounts in your name at other financial institutions as you direct. Tangerine uses this data for the following purposes: (1) displaying data from your accounts to you, (2) confirming bank account ownership information, (3) establishing a link between the accounts you hold at Tangerine (“Tangerine Accounts”) and the accounts you hold at other financial institutions (“External Accounts”) in order to facilitate movement of funds between your Tangerine Accounts and your External Accounts, (4) providing you with more relevant marketing offers, (5) providing you with more accurate financial recommendations, and (6) other purposes as described in the Tangerine Privacy Code (the “Service”).
By using this Service and submitting information, data, passwords, usernames, PINs, other login information and other content (“Submitted Information”) to Plaid through the Service, you authorize and instruct Tangerine and its trusted service provider, Plaid, to communicate with selected third party financial institutions on your behalf as your agent, for the purposes of providing Tangerine with information about you and your External Accounts.
You expressly authorize these third parties to disclose your information to Plaid from time to time. When you use the Service, Plaid will use the Submitted Information that you provided to log into the online banking website(s) of other financial institution(s). You authorize and permit Plaid to use and store your Submitted Information and to configure the Service so that its compatible with any websites where your information is stored until you advise us that you’d like to stop using the Service by clicking ‘Remove’ on the screen where your External Accounts are displayed or by any other methods made available by Plaid and/or Tangerine.
When you share the Submitted Information with Plaid, you understand Tangerine will not help, support or facilitate the provision of information to Plaid in any way and Tangerine will not be responsible for the information retrieved by Plaid. In addition, Tangerine will not be responsible to you for any losses that may result from (1) you sharing the Submitted Information or (2) you using the Service. You are responsible for reviewing the security and privacy standards and the terms of use of your other financial institutions regarding your External Accounts (or otherwise as applicable) to determine your potential liability in connection with the Service. You will change your password, PINs and/or other login information (as applicable) immediately when you end your use of the Service. Please note that for security and system reasons, we have the right to prevent other parties from accessing your Tangerine Accounts.
You authorize and direct Tangerine and Plaid to do, on your behalf, all things necessary to provide the Service to you. This may include for example, visiting the website of another financial institution and providing your log-in information or other information to register, access, retrieve and download your financial information in connection with your External Accounts.
You acknowledge that you've reviewed your agreement(s) with the applicable third parties (such as any services agreements at other institutions where you maintain External Accounts) and confirm that you understand your obligations under those agreement(s) and that you voluntarily agree to use the Service. You confirm that you have the right to give us the authorization and direction described above. In particular, you confirm that your use of the Service is not contrary to any terms or conditions imposed by other entities from whom you instruct Tangerine or Plaid to access information. You are solely responsible for reviewing agreements you have with organizations other than Tangerine to determine if you are permitted to disclose the information we require to provide the Service to you, what the consequences of such disclosure may be, and your liability in connection with such disclosure.
You may terminate the collection of your personal information by removing the External Account to which it relates from the Service at any time.
When you use the Service, your information is accessed and retrieved on your behalf. We are not responsible for the timeliness, completeness or accuracy of information from External Accounts. Further, not all information may be accessible through the Service, and you remain responsible for keeping apprised of information which is not. In addition, you acknowledge that certain information collected from your External Accounts may not be displayed through the Service, although it may be otherwise used in delivering the Service to you. You remain responsible for accessing the website or online service of individual organizations to view any information or content from them, including any notices, disclosures or disclaimers.
You license to us the use of any information, data, passwords, materials or other content (collectively, "Content") you provide through your use of the Service. We may use, modify, display, distribute and create new material using such Content to provide the Service to you without any time limit and without the payment of any fees or royalties. If you do not own the Content, you represent that you have obtained the rights to license our use of the Content from the owner. You also agree that all Content you provide to us is correct and complete, and to notifying us promptly of any changes to that Content.
The Service and information, advice, products and other content (including that of third parties) accessible from the Service are: (i) provided on an "as is" and "as available" basis; (ii) used at your sole risk; and (iii) not subject to any warranties (whether express or implied) form us and we expressly disclaim any such warranties. We do not provide tax, legal, or investment advice, or investment brokerage services through the Service. You are solely responsible if you choose to use any recommendations made in conjunction with the Service.
Your use of the Service grants Plaid the right to access and transmit your personal and financial information and indicates your agreement to the transmission, storage and processing of your financial information in accordance with the Plaid End User Privacy Policy.
Privacy
Tangerine recognizes the importance of your personal information, and we never take for granted the trust that you - as a Client have placed in us to protect that information. The Tangerine Privacy Code forms part of these terms and conditions, and applies to your relationship with us. Information we collect about you
Information that we collect about you will often come from you directly (for example, when you apply for a new product). We may tell you that certain information is mandatory. If you do not provide personal information that is required for a particular product or service, then we may not be able to provide it, or meet all our obligations to you. We may also collect information about you from other sources, including information from credit agencies (for example, where you apply for credit, or where we must identify you), people appointed to act on your behalf, our social media pages, or other banks or financial institutions (for example, where you have switched your accounts to us, or where we have received information to investigate incorrect payments).
How we use your information
We will process your information where you have provided us with consent to use it, where processing will allow us to take actions that are necessary to provide you with the product or service you want, to allow us to meet our legal obligations (for example, to identify you), to understand how Clients use our services or to manage our risks. We may also use your information to send you messages, either by post, telephone, text message, email or other digital methods, including through ABMs, apps, and online banking services. These messages may be to help you manage your Account, to meet our regulatory obligations, to inform you about product or service features or to tell you about products and services (including those of other companies) that may be of interest to you.
Who we will share your information with
We will keep your information confidential, but we may share it with third parties (who also have to keep it secure and confidential) in certain circumstances, including: the Scotiabank Group of Companies† (for example, for marketing purposes or internal reporting where those companies provide services to us), payment processing services (for example, credit card networks), our service providers and their agents (for example, collection agents, statement printers), fraud prevention agencies, and other banks or financial institutions. Some of these third parties may be located outside Quebec or Canada.
Keeping your information
We will keep your information for as long as you are our Client. Once our relationship has ended, we will only keep your information for so long as is appropriate for the type of information, and the purpose for which we’re retaining it. The period we keep your information for is generally linked to the amount of time available for you to bring a legal claim. We may keep the information longer than this, if there an existing claim or complaint that will require us to keep your information or for regulatory or technical reasons. If we do keep it for a longer period, we will continue to protect your information.
Automated Processing and Decision Making
The way we analyze your personal information may involve automated decisions. That is, we may process your personal information using software that can evaluate your personal circumstances and other factors to address risks or outcomes. We may use such methods to make decisions about you relating to credit checks, identity and address checks, monitoring your Account(s) for fraud or other financial crime or for other reasons that we’ll disclose to you.
Your rights and how to refuse or withdraw your consent
You have certain rights over the personal information we hold about you, including the right to ask for a copy of the information, to correct or rectify personal information that we hold about you or not to use your information for a particular purpose (i.e. withdraw consent). Note that your ability to exercise these rights will depend on a number of factors, and in some situations, we may not be able to agree to your request. You can refuse to consent to our collection, use or disclosure of your personal information, or you may withdraw your consent to our further collection, use or disclosure of your personal information at any time by giving us reasonable notice, subject to limited exceptions. This includes withdrawing your consent to use your Social Insurance Number to verify credit information or to confirm your identity. You acknowledge that the French and English versions of this Agreement were remitted to you. You expressly request and agree to be bound exclusively by the English version of this Agreement and that all related documents, including any notices, be drafted in English only. Vous reconnaissez que les versions françaises et anglaises de cette convention vous ont été remises. Vous demandez expressément et acceptez d’être lié exclusivement par la version anglaise de cette convention et que tous les documents qui s’y rattachent, y compris les avis, soient rédigés en anglais seulement.
