2023-24 Tangerine Bank Shot Contest Official Rules

The Tangerine Bank Shot contest (the “Contest”) is brought to you by Tangerine Bank (“Tangerine” or “Sponsor”) with its head office located at 3389 Steeles Avenue East, Toronto, Ontario M2H 0A1. The Contest will be administered on behalf of Tangerine by MKTG Canada Corp. (“Administrator”) with offices located at 1 University Ave, Toronto, ON M5J 2P1 (“Administrator’s Offices”). Contest is void in whole or part where prohibited by law. See Eligibility section below for further details. Participation in the Contest constitutes full and unconditional agreement and acceptance of these Official Contest Rules (the “Rules”) (which may be amended by Tangerine Bank from time to time in its sole discretion). All dollar amounts are in Canadian funds ($CDN) unless otherwise noted. Entrants acknowledge and agree that MLSE’s sole and exclusive role in the Contest is that of Prize supplier and that MLSE is in no way responsible for the administration of the Contest or the selection of winners.

The Contest will begin on October 25, 2023 at 8:00 a.m. Eastern Time ET and will end on April 14, 2024 at 11:59 p.m. Eastern Time ET (the “Contest Period”).

The Contest is open to legal residents of Canada who have reached the age of majority at the time of entry in their province/territory of residence, except employees of Tangerine or any of its affiliates (including Scotiabank®) and those with whom such employees are domiciled, shareholders, their advertising and promotional agencies, agents, mandataries, and immediate family members and/or those living in the same household of such employees (“Contest Parties”).

No purchase or Account opening necessary to enter or win. A purchase or Account opening will not increase your chances of winning. Void where prohibited.

To enter, eligible participants must sign up on the Sponsor’s website at tangerine.ca/bankshot, which includes all draws outlined in sections 4 and 5 below.

There is a limit of one (1) entry per person. If it is discovered that an entrant has attempted to: (i) enter more than one (1) time; or (ii) use or attempt to use multiple names, Tangerine Accounts, or identities to enter, or otherwise participate in, the Contest, then in the sole and absolute discretion of the Sponsor the entrant may be disqualified from participation in the Contest. Use or attempted use of multiple identities, mail-in envelopes, and/or any automated system to enter or otherwise participate in this Contest is prohibited and is grounds for disqualification.

During the Contest Period, for every Bank Shot (as defined by the NBA at nba.com/stats/team/1610612761/shooting?SeasonType=Regular+Season) scored by the Toronto Raptors in a regular season game, Tangerine will administer a draw (each a “Draw”) for a prize (each a “Prize”) as described below. Draws are dependent on the performance of the Toronto Raptors, and the associated Prizes will only be awarded based on their scoring of successful Bank Shots, except at the discretion of the Sponsor.

There are up to one hundred fifty (150) Prizes available to be won, as follows:

Prize for Bank Shot #1: One (1) Prize of a trip for winner and a guest to a Raptors 23-24 regular season road game between January 1, 2024 and April 10, 2024, as chosen by the Sponsor. Approximate retail value: $10,000.

Prize for Bank Shots #2-10: Nine (9) Prizes of one (1) NBA League Pass Premium pass. Total retail value: $2,250 ($250 each).

Prize for Bank Shot #11: One (1) Prize of a trip for winner and a guest to the 2024 NBA All-Star Game at Gainbridge Fieldhouse Arena in Indianapolis, Indiana on February 18, 2024. Approximate retail value: $10,000.00.

Prize for Bank Shots #12-20: Nine (9) Prizes of one (1) Toronto Raptors Raised Cuffed Toque. Total retail value: $242.91 ($26.99 each).

Prize for Bank Shot #21: One (1) Prize of a trip for winner and a guest to the Raptors 24-25 Home Opener Game. Approximate retail value: $10,000.

Prize for Bank Shots #22-30: Nine (9) Prizes of one (1) Toronto Raptors New Era Men’s 2023 Draft Toque. Total retail value: $350.91 ($38.99 each).

Prize for Bank Shot #31: One (1) Prize of a trip for winner and a guest to an NBA Summer League 2024 game, as chosen by the Sponsor. Approximate retail value: $10,000.

Prize for Bank Shots #32-40: Nine (9) Prizes of one (1) Toronto Raptors Men’s 9Twenty Adjustable Hat. Total retail value: $314.91 ($34.99 each).

Prize for Bank Shot #41: One (1) Prize of a trip for winner and a guest to an NBA 23-24 Finals Game. Approximate retail value: $10,000.

Prize for Bank Shots #42-60: Nineteen (19) Prizes of one (1) Toronto Raptors New Era Men’s 2023 Draft Hat. Total retail value: $911.81 ($47.99 each).

Prize for Bank Shots #61-80: Twenty (20) Prizes of one (1) Toronto Raptors autographed ball (Sponsor’s choice). Approximate total retail value: $2,000 ($100 each).

Prize for Bank Shots #81-100: Twenty (20) Prizes of one (1) Toronto Raptors autographed jersey (Sponsor’s choice). Approximate total retail value: $7,100 ($355 each).

Prize for Bank Shots #101-120: Twenty (20) Prizes of one (1) Toronto Raptors Nike Men's 2022 Swingman Association Jersey (Sponsor’s choice). Total retail value: $3,399.80 ($169.99 each).

Prize for Bank Shots #121-140: Twenty (20) Prizes of one (1) Toronto Raptors Nike Men's 2022 Swingman Icon Jersey (Sponsor’s choice). Total retail value: $3,399.80 ($169.99 each).

Prize for Bank Shots #141-150: Ten (10) Prizes of one (1) Toronto Raptors MOJO Premium Laptop Tote Bag. Total retail value: $1,209.90 ($120.99 each).

Potential total approximate retail value of all Prizes is $71,180.04. Any difference between the approximate retail value and the actual value of any Prize as taken will not be awarded. There is a limit of one (1) Prize per entrant during the Contest Period. If an entrant has successfully been awarded one (1) Prize, they will no longer qualify for subsequent Draws. If fewer than 150 Bank Shots are scored by the Toronto Raptors during regular season games, fewer than 150 prizes will be drawn or awarded. In no event will there be more prizes awarded than Bank Shots scored.

With respect to all trip Prizes (Prizes for Bank Shots #1, 11, 21, 31 & 41), Prize includes round trip economy airfare for two (2) from an airport within 100km of the winning entrant’s home address as determined by Sponsor and where reasonably possible, two (2) nights of standard hotel accommodations (one double occupancy room) as determined by Sponsor. Accommodations and flight times are subject to availability and black-out periods. Reservations are subject to complimentary allotment and may not be available even if a similar flight appears on the airline’s, or other airlines’ booking websites or through another airline. The trip Prize must be taken at the time and to the destination stipulated by the Sponsor or will be forfeited. The winner and their travel guest must travel on the same itinerary and have valid travel documents (such as a passport) or the trip Prize will be forfeited. There are no deviations to travel allowed (i.e. length of stay, number of guests, flight stopovers, travel dates, etc.). All other costs and expenses associated with a trip Prize, including but not limited to, ground transportation between the winner’s residence and the departure airport and the arrival airport and the hotel, additional accommodations or overnight layover if required, COVID testing if required, travel insurance, baggage and excess baggage fees, parking fees, room service, laundry service, spa treatments, meals and beverages, in-flight meals and beverages, headsets, optional seat selection, flight entertainment, gratuities, tours and excursions, telephone calls, items of a personal nature, personal charges at lodging, tips, merchandise, souvenirs, incidental expenses, security fees and any other expenses not specifically described as included in the Prize are the responsibility of the winner and their guest. No change in travel arrangements can be made once the booking has been confirmed. The Releasees will not be responsible for risk associated with any travel elements, including without limitation, air travel, and quality of service provided by the airline, hotel staff and management, the trip organizers, or any other service providers.

For any Prizes awarded to winner and a guest (Prizes for Bank Shots #1, 11, 21, 31 & 41), winner’s guest must have reached the age of majority in their province or territory of residence prior to the trip/experience, or the winner must be the parent or legal guardian of the minor guest.

Except at the discretion of Sponsor, Prizes are not transferable, assignable or convertible to cash (except as may be specifically permitted by the Sponsor in its sole and absolute discretion) and must be accepted as awarded. The Sponsor reserves the right to substitute any Prize in whole or in part if all or any of the components of the Prize are unavailable for any reason, including for a trip Prize if the winner doesn’t require airfare, or in the event that an in-person experience can’t be fulfilled, with another prize of equal or greater approximate value, including, without limitation, but solely at the Sponsor's sole discretion, a cash award. In the event that the winner is unable to redeem any or all of the Prize due to reasons beyond the control of the Sponsor, its employees, representatives, agents and all parties associated with this Contest, no compensation or substitution prize will be provided. Any costs or expenses incurred by the Winner in claiming or using any Prize except as described above will be the responsibility of the Winner. The characteristics and features of each Prize component, unless otherwise explicitly described above, are at the Sponsor’s sole discretion and are subject to change.

All Draws will take place at the Administrator’s Offices at or about 1:00 p.m. ET on the first Monday of each calendar month during the Contest Period (each a “Draw Date”). If a Draw Date falls on a holiday, then the Draw Date will take place on the next business day. Draws will be conducted based on the number of Bank Shots scored during the previous month, as outlined in section 4 above. The draws will be conducted in the order of the applicable Bank Shots scored. On each Draw Date, enough potential Prize winners will be selected to fulfill the number of Prizes available by random draw among all eligible entries received during the Contest Period up until 11:59:59 p.m. ET the day before the applicable Draw Date. Odds of being selected will depend upon the total number of eligible entries received by the Sponsor before the applicable Draw Date.

Entries that are not selected as part of any Draw will be carried forward to any future draws, subject to the Prize limit described in section 4 of these Rules.

For all Draws, within 48 hours of any Draw Date, selected entrants will be notified by the Sponsor or Administrator by telephone or email and given instructions on how to contact the Sponsor to claim the applicable Prize. The Sponsor or the Administrator will make a maximum of one (1) attempt to contact the selected potential Prize winner. If a selected entrant can’t be contacted within 48 hours of the applicable Draw Date, or if there is a return of any notification as undeliverable, the Prize will be forfeited and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate potential Prize winner from among the remaining eligible entries for that Draw (in which case the foregoing provisions of this section will apply to the new selected entrant), and this process may continue until a potential Prize winner has been successfully contacted.

Before being declared a confirmed Prize winner (the “Winner”), the selected potential Prize winner will be required to: (a) correctly answer a time-limited mathematical skill-testing question; and (b) sign and return within 24 hours of receipt the Sponsor's declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize as awarded; (iii) releases the Releasees (as defined below) from any and all liability in connection with this Contest; and (iv) agrees to the publication, reproduction and/or other use of the Winner’s name, address (city and province), voice, statements about the Contest and/or photograph, image or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the Internet and grants to the Sponsor, in perpetuity, a non-exclusive licence to publish, display, reproduce, modify, edit or otherwise use the material contained in the entry, in whole or in part, for advertising or promoting the Contest or for any other reason and waives all moral rights in and to the Winner’s entry in favour of the Sponsor. If a selected potential Prize winner: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed release and other Contest documents within the specified time; (c) can’t (or is unwilling to) accept his/her Prize as awarded for any reason; and/or (d) is not in compliance with these Rules, then they will be disqualified and will forfeit all rights to the Prize and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate potential Prize winner from among the remaining eligible entries for the Prize (in which case the foregoing provisions of this section will apply to the new selected entrant), and this process may continue until a Winner has been successfully awarded the Prize or until the Sponsor terminates the Contest in accordance with these Rules, whichever happens first.

Anyone determined by the Sponsor to be in violation of these Rules for any reason is subject to disqualification in the sole and absolute discretion of the Sponsor at any time.

By entering this Contest, entrants accept and agree to be bound by these Rules, including all eligibility requirements and the decisions of the Sponsor, the Administrator and the independent judging organization, if any, which are final and binding without right of appeal on all matters relating to this Contest. All entries become the property of the Sponsor and will not be returned or acknowledged. Entries will not be acknowledged and no correspondence will be entered into except with potential Prize winners. The Sponsor reserves the right to disqualify any entrant who fails to comply with these Rules or who make any misrepresentation relating to the Contest, Draws and redemption of any Prize.

By participating, entrants release (and in the case of the confirmed Winner of a trip Prize, the confirmed winner agrees to cause each of his/her guests to release) and hold harmless the Sponsor, MLSE, the Administrator and their respective affiliates, and each of their respective directors, officers, employees, agents, mandataries, representatives, successors and assigns, advertising and promotional agencies affiliated with this Contest, participating establishments and any independent contest judges appointed by Sponsor (collectively the “Releasees”) from any claims, actions, injury, loss, or damage of any kind, including, but not limited to, illness, personal injury or death, resulting, directly or indirectly, in whole or in part, from participating in this Contest or from the acceptance, possession, or use or misuse of any Prize or any portion thereof (including any travel/activity related thereto). This limitation of liability is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation): compensatory, direct, indirect, or consequential damages; loss of data, income or profit; loss of damage to property; and claims of third parties.

The Sponsor and the Administrator won’t be responsible for any failure of email during the Contest or for any problems or technical malfunction of a telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any email, online, or Internet entry to be received by the Sponsor. In addition, the Sponsor or the Administrator won’t be responsible for technical problems, traffic congestion on the Internet or at any website, or any combination of these including any injury or damage to an entrant's or any other person’s computer or property related to or resulting from playing or downloading any material related to the Contest. The Sponsor reserves the right, at its sole discretion (subject only to applicable laws, including without limitation, any laws or regulations under the Régie des alcools, des courses et des jeux (the “Régie”), to cancel, suspend, extend or modify this Contest without notice, obligation or liability if in the Sponsors’ opinion there is any suspected or actual evidence of tampering with any portion of the Contest, or if virus, bugs, non-authorized human intervention, force majeure or other causes corrupt or impair the administration, security, fairness, or integrity and proper play of the Contest, or for any other reason in the Sponsor’s sole discretion. In such case, the Sponsor may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest may be a violation of criminal and civil laws, and, if such an attempt is made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. Entries are subject to verification and will be declared invalid if they are illegible, incomplete, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way, or otherwise not in compliance with these Rules.

If a dispute arises regarding who submitted an entry, the entry will be deemed to be submitted by the authorized account holder of the email account provided at time of entry. Authorized account holder is defined as the natural person who is assigned to an email address by an Internet access or online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.

The Sponsor or the Administrator won’t be responsible in any way for the use of, or bear any liability whatsoever in any way attributable to, any Prize awarded in this Contest or the events forming part of this Contest, including but not limited to typographical or other errors in the offer or administration of this Contest, these Rules, the selection and announcement of Winners or the distribution of any Prize. The Releasees: (i) make no warranty, guaranty or representation of any kind concerning the Prizes or any component of the Prizes; and (ii) disclaim any implied warranty or condition.

In the event of any discrepancy or inconsistency between the terms of these Rules and the terms or statements contained in any short-form Contest rules, advertising materials and/or the French version of these Rules, the terms and conditions of these English Rules will prevail, govern and control to the fullest extent permitted by applicable law.

The Sponsor is committed to respecting the privacy rights of entrants. Any personal information collected will be handled in strict accordance with the Tangerine Privacy Code found at tangerine.ca and all applicable privacy legislation. The Sponsor won’t sell any personal information collected for this Contest to any third parties. Except as otherwise set forth here with respect to the Winner, any personal information collected for this Contest will be collected, used and disclosed by the Sponsor and the Administrator solely for the purpose of managing and administering this Contest. By entering this Contest, the entrant consents to the Sponsor's and the Administrator’s collection, use and disclosure of the entrant's personal information in order to manage and administer this Contest.

This Contest is subject to all applicable federal, provincial and municipal laws. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, will be governed by, and construed in accordance with, the substantive laws of the Province of Ontario without regard to Ontario conflicts of law principles. All entrants consent to the jurisdiction and venue of the Province of Ontario.

To obtain the names of the official Winners, available seven (7) days after each Draw Date email your request to bankshotcontest@tangerine.ca.

Any litigation respecting the conduct or organization of this Contest may be submitted to the Régie for a ruling. Any litigation regarding the awarding of a Prize may be submitted to the Régie only for purposes of helping the parties reach a settlement.
