Summary of Changes to Your Tangerine Credit Card Cardholder Agreement

Definitions and General Updates: We’ve updated the definitions to reflect some of the changes below. We’ve also made a few administrative updates to help improve the document’s readability and to simplify it, including using a generic name for our Credit Card (Tangerine Credit Card Account).

Loss, Theft or Unauthorized Use: We’ve updated the “Loss, Theft or Unauthorized Use” section so that it describes in more detail how to protect your Card, PIN, and Account from unauthorized use. We’ve more clearly stated that we’ll investigate when you report suspected unauthorized transactions on your Account or the unauthorized use of your Card, even when a PIN is used.

Minimum Payment: For residents of the province of Québec, the formula for calculating Minimum Payments is changing effective August 1, 2019, as outlined below. This will be updated in the Disclosure Statement for your Account (as shown below). Corresponding changes to the Cardholder Agreement have also been made. See the section “Minimum Payment” for more details.

Foreign Currency Transactions: We’ve added more detail to better explain how foreign currency transactions are converted before they’re posted to your Account. In particular, we’ve explained that some foreign currency transactions may be converted first into U.S. dollars (or another currency) and then Canadian dollars, depending on the type of currency involved, before they’re posted to your Account. See the “Foreign Currency Transactions and Fees” section for more details.

Changing the Agreement: We’ve updated the section on making changes to the Cardholder Agreement and how you can notify us if you don’t agree or consent to a change. See the “Changes to this Agreement” section.

If you reside outside the province of Québec, the Minimum Payment for your Account remains as is and isn’t impacted by the change below.

For residents of the province of Québec who have an Account opened before August 1, 2019, your monthly Minimum Payment is changing and will be calculated as follows starting on August 1, 2019:

2.50% of your outstanding New Balance on your statement each month.

The 2.50% will increase by 0.50% increments in each 12 month period after August 1, 2019 (to a maximum of 5.00% of the outstanding New Balance that appears on your statement each month) as outlined in the table below.
For example, effective August 1, 2020, instead of the Minimum Payment being 2.50% of the outstanding New Balance on your statement, it will be 3.00% of the outstanding New Balance on your statement.

For residents of the province of Québec who open a new Account on or after August 1, 2019, the Minimum Payment is also changing and will be 5.00% of the outstanding New Balance on your statement each. Full details about the Minimum Payment will be provided at the time of application for the Credit Card Account.

Important Notice about Updates to the Tangerine Credit Card Cardholder Agreement and a Change to Your Tangerine Money-Back Credit Card Account Effective August 1, 2019
We’re writing to let you know about some updates we’re making to the Tangerine Credit Card Cardholder Agreement that applies to your Tangerine Money-Back Credit Card Account (the “Account”) and a change that will apply to the minimum payment on the Account for residents of the province of Québec. Please review this information and keep it for reference. An online copy is available at: tangerine.ca/creditcardlegal.
For your reference, we’ve enclosed an updated copy of the Cardholder Agreement that will be in effect August 1, 2019. Please review it carefully. Below is a summary of the key updates we’re making to the Cardholder Agreement.

New Changes to the Disclosure Statement for your Account:
Minimum Payment
Your required Minimum Payment is the sum of Interest + Fees + $10, in addition to any over-limit or past due amounts. If your balance is less than $10, the Minimum Payment will be the balance.
New for Residents of the province of Québec only

the Card, Account or Card PIN was used by a person other than you or any Cardholder and without any actual or implied consent or authorization;

you or any Cardholder did not receive any benefit from the use;

you and any Cardholder fulfilled all obligations under the agreement including exercising reasonable care to safeguard the Card, Account or Card PIN against loss, theft or unauthorized use including; and
-
you cooperated fully with us in our investigation.
For Residents of the Province of Québec Only (Effective August 1, 2019):
For Accounts opened on or after August 1, 2019: Your required Minimum Payment is the greater of 5.00% of the outstanding New Balance on your statement or $10.
For Accounts opened before August 1, 2019: Your required Minimum Payment is the greater of:
A. 2.50% of the outstanding New Balance on your statement
2.50% will increase by increments of 0.50% of the outstanding New Balance shown on your statement in each 12 month period from August 1, 2019, until it reaches 5.00% as shown below:

B. $10
In addition, in all cases your Minimum Payment will include any over-limit or past due amounts. If your outstanding New Balance is less than $10, the Minimum Payment will equal the balance.

Changes to Your Tangerine Credit Card Cardholder Agreement (the “Agreement”) effective August 1, 2019
Definitional changes: All references to “Tangerine Money-Back Credit Card Account” in the Agreement have been changed to “Tangerine Credit Card Account”. Below are the additional changes in the Agreement identified by section or heading:
Loss, Theft or Unauthorized Use (New s.28)
(Formerly s. 28 “Unauthorized Transactions” and s.29 “Lost or Stolen Cards”
Unauthorized Transactions: It is your responsibility to protect your Card and Credit Card Account against unauthorized Transactions, theft, misuse, or loss immediately. You must immediately inform us by telephone about any actual or suspected loss, theft, or unauthorized use of your Card or Card PIN. If you don’t advise us as soon as you are aware of any unauthorized Transactions, you agree that we may assume you have authorized all Transactions.
Lost or Stolen Cards: You must notify us immediately if you learn of the loss, theft or misuse of your Card, or if you know or suspect that someone else knows your PIN. If your Credit Card is lost or stolen, you will not be liable for any unauthorized use if you have exercised reasonable care to safeguard your Card, PIN or Password against loss or theft; you have not reported more than 2 unauthorized uses of your Card in the past 12 months; and your Account is in good standing. If your PIN or Password is used in a transaction related to theft, fraud or misuse, you may be liable for the full debt, including interest arising from such use, if we determine that you inadequately protected your PIN or Password. If you have previously authorized someone to use your Credit Card and have subsequently withdrawn your authorization, you will continue to be liable for all Transactions they incur.
Tangerine may, from time to time, offer you the option of pausing your Card and the Credit Card Account temporarily. In that event, while the Card or Credit Card Account remains paused temporarily, Tangerine reserves the right to cancel the Card at any time if it suspects fraud, loss, or theft. If you suspect your Card has been lost or stolen, you must not use the pause feature and instead notify us immediately of the loss, theft, or misuse of the Card.
It is your responsibility to protect your Card, Card PIN and Credit Card Account against theft, loss or unauthorized use. You must tell us immediately by telephone, in writing or any other means we permit about any actual or suspected loss, theft, or unauthorized use of your Card, Account or Card PIN. You agree that we may consider all Transactions and other use as authorized by you until you tell us otherwise.
If you report any loss, theft or unauthorized use of a Card, Account or Card PIN, you are not responsible for that use if, after we have investigated the matter, we determine that:
If you meet the above criteria, we will consider the use “unauthorized use” and you are not liable for any Transactions (including interest) that occurred as a result of that unauthorized use.
When you tell us that a Card or Card PIN was lost or stolen, we will block the Credit Card Account to prevent unauthorized use. As such, you will not be liable for any Transactions made on the Credit Card Account that occur after you tell us that a Card or Card PIN was lost or stolen because we will consider that unauthorized use.
Tangerine may, from time to time, offer you the option of pausing your Card and the Credit Card Account temporarily. In that event, while the Card or Credit Card Account remains paused temporarily, Tangerine reserves the right to cancel the Card at any time if it suspects fraud, loss, or theft. If you suspect your Card has been lost or stolen, you must not use the pause feature and instead notify us immediately of the loss, theft, or misuse of the Card as described above.
Limiting the number of Cards and Credit Card Accounts
We have the right to limit the number of Cards issued on one Credit Card Account. The Primary Cardholder can only be on one Credit Card Account with us.

Minimum Payment
Minimum payment: The monthly statement will show a minimum payment that the Primary Cardholder must make that month on or before the Payment Due Date. The minimum payment is the total of: $10, plus interest, fees, any amount over the Credit Limit, and any amount past due as of the Statement Date. For Balances of less than $10, the minimum payment will be equal to the outstanding Balance and will be due in full on the Payment Due Date.
The monthly statement will show a Minimum Payment that we must receive from the Primary Cardholder that month on or before the Payment Due Date. The way we calculate your Minimum Payment is shown on your Disclosure Statement and is available at tangerine.ca. For Balances that are less than the Minimum Payment, the Minimum Payment will equal the outstanding Balance.
Foreign Currency Transactions and Fees
We bill you in Canadian currency for all Transactions you make (or return) in a foreign currency. We convert your Transactions into Canadian currency using the exchange rate set by Mastercard International Incorporated that is in effect on the day we post the Transaction to your Account. This exchange rate may be different from the rate in effect on the Transaction date. We will also charge you a foreign currency conversion fee. This fee is described in your Disclosure Statement.
The conversion rate shown on your monthly statement includes Mastercard International Incorporated’s exchange rate and the foreign currency conversion fee we charge you. The conversion rate shown in your monthly statement only displays the first three decimal places (following the decimal point), even though we use the more detailed calculation explained above to convert to Canadian dollars.
If the Card is used for a Transaction in a foreign currency, and the Transaction is subsequently cancelled or returned, the credit to the Account will not be exactly the same as the original Transaction because we do not reverse the foreign currency conversion fee, and the exchange rate.
We will bill you in Canadian currency for any amount incurred in a foreign currency on your Credit Card Account (including returns). We will convert foreign currency amounts into Canadian currency at the exchange rate set by Mastercard International Incorporated (“Mastercard”) in effect on the date we post the Transaction to your Credit Card Account. This exchange rate may be different from the rate in effect on the Transaction date. When the amount is posted to your Credit Card Account, in addition to the exchange rate, you will be charged a foreign currency conversion fee for each converted amount. The foreign currency conversion fee is disclosed in your Disclosure Statement and applies to both debit and credit transactions. Any amount incurred in a foreign currency on your Credit Card Account may be converted into another currency (such as U.S. Dollars) before it is converted to Canadian Dollars and posted to your Credit Card Account. Credits to the Credit Card Account involving a foreign currency will also be converted directly to Canadian Dollars, or first to U.S. Dollars and then to Canadian Dollars, depending on the foreign currency as described above. Whether or not foreign currency will be converted directly to Canadian Dollars before being posted in your Credit Card Account is determined by Mastercard and is subject to change. If the Card is used for a Transaction in a foreign currency, and the Transaction is subsequently cancelled or refunded, the credit to the Credit Card Account will not be exactly the same as the original Transaction because we do not reverse the foreign currency conversion fee and the exchange rate may be different on the date when the cancelled or refunded Transaction is posted to your Credit Card Account. Once the credit has been processed, you will be required to pay any remaining balance of the Transaction resulting from an exchange rate differential.

Statements
We will provide a monthly statement to the Primary Cardholder if there has been any activity on the Credit Card Account during the last month, or if there is any outstanding Balance. Statements may not be provided on the same date in each month and therefore the Payment Due Date on your statement may not always be the same. Each statement normally covers between 28 and 33 days. If, during any three-month period, the Credit Card Account has an outstanding credit Balance that is less than $10, and there has been no activity on the Credit Card Account during that three-month period, we may provide you with a statement only at the end of that three-month period. We do not provide monthly statements if this Agreement or your Credit Card Account has been suspended or cancelled and we have demanded repayment of the outstanding Balance.
It is your responsibility to keep your address and contact information with us up-to-date. If your statement is returned to us because of an incorrect address, we will not send you any more statements to that address. In addition, we may suspend charging privileges for your Credit Card Account until you give us the correct address.

This Agreement sets out the Terms and Conditions applicable to your Cards and Credit Card Account. We may also provide other benefits with the Card, such as a Money-Back Rewards program. The initial principal features and Terms and Conditions of any such program are provided in a separate Rewards Program Terms & Conditions booklet, which is provided to you with the Card. The most current version of the Rewards Program Terms & Conditions is also available on our website; at tangerine.ca. Rewards programs may be changed or cancelled by us at any time, without prior notice to you.
This Agreement sets out the Terms and Conditions applicable to your Card(s) and Credit Card Account. We may also provide other benefits with the Card, such as a rewards program. We will provide you with the initial principal features and Terms and Conditions of any such program, typically in a separate Rewards Program Terms & Conditions booklet, which is provided to you with the Card or by such other means as we determine. Changing the Agreement
We may change any of the following elements of our contract with you: annual interest rate(s), annual fee, any other fees and/or charges for your Credit Card Account; and any other terms and conditions set out in your Disclosure Statement or in this Agreement. Before we make these changes we will send a notice to the Primary Cardholder describing the changes and the effective date. We will provide at least the minimum advance notice required by law. Except for changes to the interest rate, you may refuse changes we make and cancel this Agreement. To do so, you must send written notice to us no later than thirty (30) days after the changes are effective.
We may also change or terminate any benefits, services or coverages associated with any Card or the Credit Card Account, at any time, unless advance notice or notice in some other way is required by law. Except if we change this Agreement in writing, any waiver by us of any provision of this Agreement will not be considered a precedent for waiving that or any other provision of this Agreement.
You agree that we may make changes to this Agreement or the services that are available for your Card or Credit Card Account but we will give you notice in writing before we do so (or at any time as permitted by law).
We may change any of the following sections or elements of this Agreement with you: annual interest rate(s), annual fee, any other fees and/or charges for your Credit Card Account; and any other terms and conditions set out in your Disclosure Statement or in this Agreement including the payment network associated with the Card or Credit Card Account and any of these sections and all elements under the following headings in this Agreement:
Before we make these changes we will provide the Primary Cardholder with a written notice at least 30 days in advance of any change setting out the change, the effective date the change comes into force and your right to refuse the change and to cancel this Agreement without cost, penalty or cancellation indemnity to you other than for a change to the annual interest rate(s) and any annual fee or any other change where your consent is not required by law.
You must notify us within 30 days of the effective date of the change if you do not agree with that change. If you notify us within that 30 day period that you do not agree with the change, we will cancel this Agreement and any outstanding Balance or any other amount you owe under this Agreement will immediately become due.
Subject to applicable law, we will consider you to have accepted any change if you do not notify us within 30 days of the effective date of any change that you do not agree with the change or if you keep the Credit Card Account open, use the Credit Card Account or if there is any outstanding Balance or other amount owing on the Credit Card Account after the effective date of the change.
We may also change or terminate any benefits, services or coverages associated with any Card or the Credit Card Account, at any time, unless advance notice or notice in some other way is required by law. Except if we change this Agreement in writing, any waiver by us of any provision of this Agreement will not be considered a precedent for waiving that or any other provision of this Agreement.
For the purposes of this section, any “written” notice or notice “in writing” may be provided by us to the Primary Cardholder electronically if that Primary Cardholder has expressly consented to receive such notices electronically and if we agree to send those notices to the Primary Cardholder electronically.
